Agreement to Terms

By accessing or using FRESH. Dry Cleaning & Laundry services, you agree to be bound by these Terms of Service, our Garment Care & Service Agreement, and our Privacy Policy. If you do not agree to these terms, please do not use our services.

Services

FRESH. provides professional dry cleaning, laundry, and garment care services in the Brickell, Miami area. Our services include:

• Dry cleaning
• Wash and fold laundry
• Business shirt laundering
• Alterations and repairs
• Pickup and delivery

Accounts

Some features, including scheduling and subscriptions, require an account. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms or are used for fraudulent or abusive activity.

Orders and Pricing

Minimum Order

A $30 minimum order is required for pickup and delivery service.

Pricing

Prices are subject to change. Current pricing is available on our website. Because charges depend on the actual items received, your final total is confirmed after your items are inspected, weighed, or counted.

Payment and Card on File

A valid payment card is required on file before your order is placed. By providing a card, you authorize FRESH. to charge it for all services rendered, including any applicable rush or service fees. We accept major credit cards and digital payment methods. Items will not be released for pickup or delivery until full payment has been successfully processed.

Pickup and Delivery

• You must provide accurate pickup and delivery information
• Items must be left in an accessible location (with concierge or at door as specified)
• We are not responsible for items left in unsecured locations
• Standard service turnaround: Most items are returned in 2–3 business days, including wash & fold (2 days) and dry cleaning (3 days). Alterations and shoe care take 5–7 days. Rush service is available for eligible items.
• 24-hour (next-business-day) turnaround applies to FRESH. Cycle subscriptions, commercial accounts, and eligible rush orders — not to standard à-la-carte orders
• Delivery times are estimates and may vary

Garment Care and Liability

Care and Inspection

We take every precaution to care for your garments. However:

• We are not liable for damage to garments with pre-existing conditions or inherent defects not apparent before processing
• We are not responsible for items left in pockets
• Some fabrics, embellishments, buttons, zippers, or seams may not withstand the cleaning process
• Color bleeding, fading, and shrinkage may occur despite following manufacturer care instructions
• Garments submitted without a readable manufacturer care label are processed at your own risk

Lost or Damaged Items

In the unlikely event of loss or damage caused by our facility:

• Any missing items, count discrepancies, or claims of damage must be reported within 24 hours of pickup or delivery
• Claims will not be accepted for garments that have already been worn or had our tracking tags removed
• Liability is strictly limited to 10x the service fee charged for the affected item, up to a maximum of $250 per garment
• Please remove high-value, sentimental, or irreplaceable items before using our services

Unclaimed Items

Customers must pick up or schedule delivery for completed items within 15 days of completion notification. Garments left unclaimed for more than 30 days will be considered abandoned and may be donated to a local charity.

Items We Cannot Accept

We reserve the right to refuse service for, or return unprocessed, any item that presents a health or safety risk to our staff or facility — including items contaminated with bodily fluids, hazardous chemicals, mold, or pest infestations (such as bed bugs). We may also decline items we reasonably believe we cannot clean safely.

Cancellations and Refunds

• Orders can be cancelled before pickup at no charge
• Once items are picked up and processed, cancellations are not accepted
• Refunds are issued at our discretion for valid quality concerns

Subscriptions and Memberships

FRESH. offers recurring subscription plans, including FRESH. Cycle, our monthly wash & fold service with next-business-day (24-hour) turnaround, pickup, and delivery included.

• Auto-renewal. By subscribing, you authorize FRESH. to charge your payment method on file on a recurring basis. Subscriptions automatically renew each billing period until cancelled.
• Cancel anytime. You may cancel at any time, with no notice period, through your account or by contacting us. Cancellation takes effect at the end of your current paid billing period, and your plan stays active through that date.
• No partial refunds. Fees already charged are non-refundable, and we do not provide refunds or credits for unused portions of a billing period.
• Plans and pricing. Benefits and pricing are as described on our website and may change with reasonable notice.

Text Messages and Notifications

By providing your phone number, you consent to receive transactional text messages from FRESH. about your orders, such as pickup windows and delivery updates. Message and data rates may apply, and message frequency varies. You can reply STOP to opt out at any time or HELP for assistance. Consent to receive texts is not a condition of purchase.

Promotions and Discount Codes

Promotional codes and discounts are subject to their stated terms. They may be limited to new customers or first orders, cannot be combined unless expressly stated, have no cash value, and may be modified or withdrawn at any time.

Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of FRESH. and protected by copyright laws.

Disclaimer of Warranties

Except as expressly stated in these Terms or the Garment Care & Service Agreement, our services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, FRESH. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability for any garment is limited as described in the Garment Care & Service Agreement.

Indemnification

You agree to indemnify and hold harmless FRESH. and its affiliates from any claims, damages, losses, or expenses arising from your misuse of our services or your violation of these Terms.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Garment Care & Service Agreement and the Privacy Policy, constitute the entire agreement between you and FRESH. regarding our services.

Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Before bringing any claim, you agree to first contact us so we can attempt to resolve it informally. Any dispute that cannot be resolved will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.
